1. General Information Regarding These Terms of Use
Welcome, and thank you for your interest in BrickStep ("BrickStep," "we," "our," or "us"). Unless otherwise noted on a particular site or service, this document applies to your use of all of the websites that BrickStep operates. These include https://brickstep.net/, together with all other subdomains thereof, (collectively, the "Websites"). This document also applies to all products, information, and services provided through the Websites, including without limitation the instruction generator (together with the Websites, the "Services").
This document forms a binding legal agreement between you and BrickStep in relation to your use of the Services. Collectively, this legal agreement is referred to below as the "Terms."
2. Your Agreement to the Terms
BY CLICKING "I AGREE" OR OTHERWISE ACCESSING OR USING ANY OF THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THE TERMS. By clicking "I AGREE" or otherwise accessing or using any Services you also represent that you have the legal authority to accept the Terms on behalf of yourself and any party you represent in connection with your use of any Services. If you do not agree to the Terms, you are not authorized to use any Services. If you are an individual who is entering into these Terms on behalf of an entity, you represent and warrant that you have the power to bind that entity, and you hereby agree on that entity's behalf to be bound by these Terms, with the terms "you," and "your" applying to you, that entity, and other users accessing the Services on behalf of that entity.
3. Changes to the Terms
From time to time, BrickStep may change, remove, or add to the Terms, and reserves the right to do so in its discretion. In that case, we will post updated Terms and indicate the date of revision. All new and/or revised Terms take effect from the date of revision and apply to your use of the Services from that date on. Your continued use of any Services after new and/or revised Terms are effective indicates that you have read, understood, and agreed to those Terms.
4. Content Available through the Services
Provided as-is: You acknowledge that BrickStep does not make any representations or warranties about the material, data, and information, such as data files, text, digital models, building instructions, or other files (collectively, the "Content") which you may have access to through the Services. The Content may include both user-supplied and automatically generated files. While BrickStep is not a content-sharing platform, you might have access to other users' Content, for example if another user shares a download link with you. Under no circumstances is BrickStep liable in any way for any Content, including, but not limited to: any infringing, unlawful, or offensive Content, any errors or omissions in Content, or for any loss or damage of any kind incurred as a result of the use of any Content linked from, or otherwise accessible through or made available via the Services.
5. Content Supplied by You
Definitions: All files you upload to the Services, together with any files automatically generated by the Services based on those files, are collectively referred to as "Your Content".
Your responsibility: You represent, warrant, and agree that (a) you own or otherwise have all necessary rights, licenses, permissions, and authority to upload and authorize us to process Your Content in accordance with these Terms, and (b) no files you upload to our Services violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, breach or conflict with any obligation, such as a confidentiality obligation, or contain libelous, defamatory, or otherwise unlawful material.
Licensing Your Content: You retain any copyright that you may have in Your Content. You grant us a limited, non-exclusive, worldwide, royalty-free license to access, store, copy, process, and otherwise use Your Content (including without limitation to automatically generate and provide new files based on Your Content), solely as necessary to operate, maintain, and improve the Services, including to investigate and resolve technical issues, as well as develop and test improvements to our algorithms. We may store Your Content as long as necessary for the aforementioned purposes.
Removal: BrickStep may, but is not obligated to, delete Your Content (without notice) from our Services in its sole discretion. You are solely responsible for maintaining your own backup copies. Removal of any of Your Content from the Services (by you or BrickStep) does not impact any rights you granted in Your Content under the terms detailed under "Licensing Your Content".
Security: We take reasonable measures to protect the security of the Services and the confidentiality of Your Content. However, no system can be guaranteed to be completely secure, and we cannot and do not guarantee that Your Content will never be accessed, disclosed, altered, or destroyed by unauthorized parties. See Sections 7 and 8 below for the full disclaimer. You are responsible for keeping any links allowing you to download Your Content private, as anyone who possesses a valid download link may be able to access the associated files.
6. Prohibited Conduct
You agree not to engage in any of the following activities:
Violating laws and rights:
- You may not (a) use any Service for any illegal purpose or in violation of any local, state, national, or international laws, (b) violate or encourage others to violate any right of or obligation to a third party, including by infringing, misappropriating, or violating intellectual property, confidentiality, or privacy rights.
Solicitation:
- You may not use the Services or any information provided through the Services for the transmission of advertising or promotional materials, including junk mail, spam, chain letters, pyramid schemes, or any other form of unsolicited or unwelcome solicitation.
Disruption:
- You may not use the Services in any manner that could disable, overburden, damage, or impair the Services, or interfere with any other party's use and enjoyment of the Services; including by (a) uploading or otherwise disseminating any virus, adware, spyware, worm or other malicious code, or (b) interfering with or disrupting any network, equipment, or server connected to or used to provide any of the Services, or violating any regulation, policy, or procedure of any network, equipment, or server.
Harming others:
- You may not upload or transmit Content to or through the Services that is harmful, offensive, obscene, abusive, invasive of privacy, defamatory, hateful or otherwise discriminatory, false or misleading, or incites an illegal act;
- You may not intimidate or harass another through the Services; and, you may not upload or transmit any personally identifiable information about persons under 13 years of age to or through the Services.
Impersonation or unauthorized access:
- You may not impersonate another person or entity, or misrepresent your affiliation with a person or entity when using the Services;
- You may not use or attempt to use another's personal information without authorization; and
- You may not attempt to gain unauthorized access to the Services, or the computer systems or networks connected to the Services, through hacking, password mining, or any other means.
Bypassing authorized interfaces:
- You may not access or use the Services by any means other than through the user interface provided on the Websites, unless we have expressly authorized such access. This includes, without limitation, directly invoking or attempting to invoke internal APIs, endpoints, or other interfaces that are not intended for public use, or otherwise bypassing the normal operation of the Websites.
7. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRICKSTEP OFFERS THE SERVICES (INCLUDING ALL CONTENT AVAILABLE ON OR THROUGH THE SERVICES) AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE SERVICES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BRICKSTEP DOES NOT WARRANT THAT THE FUNCTIONS OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CONTENT MADE AVAILABLE ON OR THROUGH THE SERVICES WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY SERVERS USED BY BRICKSTEP ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. BRICKSTEP DOES NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING USE OF THE CONTENT AVAILABLE THROUGH THE SERVICES IN TERMS OF ACCURACY, RELIABILITY, OR OTHERWISE. BRICKSTEP DOES NOT WARRANT THAT FILES GENERATED BY THE SERVICES ARE ACCURATE, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
8. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BRICKSTEP BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE OR INCOME, LOST PROFITS, PAIN AND SUFFERING, EMOTIONAL DISTRESS, COST OF SUBSTITUTE GOODS OR SERVICES, OR SIMILAR DAMAGES SUFFERED OR INCURRED BY YOU OR ANY THIRD PARTY THAT ARISE IN CONNECTION WITH THE SERVICES (OR THE TERMINATION THEREOF FOR ANY REASON), EVEN IF BRICKSTEP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRICKSTEP IS NOT RESPONSIBLE OR LIABLE WHATSOEVER IN ANY MANNER FOR ANY CONTENT UPLOADED TO OR AVAILABLE THROUGH THE SERVICES (INCLUDING CLAIMS OF INFRINGEMENT RELATING TO THAT CONTENT), FOR YOUR USE OF THE SERVICES, OR FOR THE CONDUCT OF THIRD PARTIES ON OR THROUGH THE SERVICES.
Certain jurisdictions do not permit the exclusion of certain warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. IN THESE JURISDICTIONS, THE FOREGOING EXCLUSIONS AND LIMITATIONS WILL BE ENFORCED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.
9. Indemnification
To the extent authorized by law, you agree to indemnify and hold harmless BrickStep, its employees, officers, directors, affiliates, and agents from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting directly or indirectly from or arising out of (a) your violation of the Terms, (b) your use of any of the Services, and/or (c) the Content you upload to any of the Services.
10. Privacy Policy
BrickStep is committed to responsibly handling the information and data we collect through our Services in compliance with our Privacy Policy, which is incorporated by reference into these Terms. Please review the Privacy Policy so you are aware of how we collect and use your personal information.
11. Trademarks
The trademarks used on the site are the registered trademarks of their respective owners. Those marks are used for referential purposes only and are not intended to suggest or imply any affiliation with or endorsement by their respective owners.
12. Copyright Complaints
BrickStep respects copyright, and we prohibit users of the Services from submitting, uploading, posting, or otherwise transmitting any Content on the Services that violates another person's proprietary rights.
If you believe material uploaded through the Services infringes your copyright, please send a notice containing sufficient information to identify the allegedly infringing material and explain the basis of your claim.
13. Termination
By BrickStep: BrickStep may modify, suspend, or terminate the operation of, or access to, all or any portion of the Services at any time for any reason. Additionally, your individual access to, and use of, the Services may be terminated by BrickStep at any time and for any reason.
By you: If you wish to terminate this agreement, you may immediately stop accessing or using the Services at any time.
Automatic upon breach: Your right to access and use the Services automatically terminates upon your breach of any of the Terms.
Survival: The disclaimer of warranties, the limitation of liability, and the jurisdiction and applicable law provisions will survive any termination. The license you granted us under "Licensing Your Content" in Section 5 is not impacted by the termination of the Terms and shall continue in effect in accordance with that section. Your warranties and indemnification obligations will survive for one year after termination.
14. Miscellaneous Terms
Choice of law: These Terms are governed by the laws of the Republic of Poland, not including its choice of law rules. If you are a consumer, this choice of law does not deprive you of any mandatory rights or protections available under the laws of your country of residence.
Dispute resolution: We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved, it shall be submitted to the competent courts of the Republic of Poland, unless applicable mandatory law provides otherwise.
No waiver: Either party's failure to insist on or enforce strict performance of any of the Terms will not be construed as a waiver of any provision or right.
Severability: If any part of the Terms is held to be invalid or unenforceable by any law or regulation or final determination of a competent court or tribunal, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
No agency relationship: The parties agree that no joint venture, partnership, employment, or agency relationship exists between you and BrickStep as a result of the Terms or from your use of any of the Services.
Integration: These Terms constitute the entire agreement between you and BrickStep relating to this subject matter and supersede any and all prior communications and/or agreements between you and BrickStep relating to access and use of the Services.

This Privacy Policy ("Policy") explains the information collection, use, and sharing practices of BrickStep ("BrickStep," "we," "us," and "our").
This Policy is incorporated into and part of BrickStep Terms of Use ("Terms").
Before you use or submit any information through or in connection with the Services, please carefully review this Privacy Policy. By using any part of the Services, you understand that your information will be collected, used, and disclosed as outlined in this Privacy Policy. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, PLEASE DO NOT USE THE SERVICES.
1. Our Principles
We have designed this policy to be consistent with the following principles:
- Privacy policies should be human readable and easy to find.
- Data collection, storage, and processing should be simplified as much as possible to enhance security, ensure consistency, and make the practices easy for users to understand.
- Data practices should meet the reasonable expectations of users.
2. Information We Collect
We collect information in multiple ways, including when you provide information directly to us and when we passively collect information from you, such as from your browser or device. We also obtain information from third party services that may collect additional information when you interact with the Services.
Information You Provide Directly to Us: We may collect any information you provide to us. We may collect information from you in a variety of ways, such as when you: (a) upload a model to the instruction generator, or (b) contact us or provide feedback. This information may include but is not limited to your email address, the contents of uploaded files, and any information you include when contacting us. The Services do not require personal information contained within uploaded files. We encourage you to refrain from uploading files containing personal information and, where practical, to remove or anonymize any personal information before uploading.
Information that Is Automatically Collected: We may automatically collect certain information about the computer or devices (including mobile devices or tablets) you use to access the Services. As described further below, we may collect and analyze (a) device information such as IP addresses, and (b) information related to the ways in which you interact with the Services, such as the date and time you used the Services, error logs, and other similar information. We also collect data about your use of the Services through the use of Internet server logs.
Information Collected through Third Parties: We may also collect information about you or others through third parties. For example, we use various Cloudflare services, including Cloudflare Turnstile, to operate, secure, and monitor the Services. Cloudflare may use cookies or similar technologies in connection with providing, securing, and optimizing its services. Refer to Cloudflare Privacy Policy for more details. We use Cloudflare to provide DNS, network security, and traffic proxying for the Services. Because traffic to the Services may be routed through Cloudflare's network, Cloudflare may process and collect technical information associated with requests, such as IP addresses, browser and device information, and information about network traffic. We also use Cloudflare's analytics and security features to monitor and protect the Services. We use Cloudflare Turnstile to protect the Service against automated abuse. Cloudflare Turnstile receives technical information about your browser, device, and network connection to determine whether requests originate from a human visitor.
3. How We Use Your Information
We may use the information we collect from and about you to:
- Fulfill the purposes for which you provided it;
- Provide and improve the Services, including to develop new features or services, take steps to secure the Services, and for technical and customer support;
- Send you status notifications which you have requested, important alerts, or other communications;
- Process and respond to your inquiries or to request your feedback;
- Conduct analytics, research, and reporting, including to synthesize and derive insights from your use of our Services;
- Comply with the law and protect the safety, rights, property, or security of BrickStep, the Services, our users, and the general public; and
- Enforce our Terms, including to investigate potential violations thereof.
Please note that we may combine information that we collect from you and about you (including automatically collected information) with information we obtain about you from third parties, and use such combined information in accordance with this Privacy Policy.
We may aggregate and/or de-identify information collected through the Services. We may use de-identified and/or aggregated statistical information about the operation and use of the Services for any purpose.
4. When We Disclose Your Information
We may disclose and/or share your information under the following circumstances:
Service Providers: We may disclose your information to third parties who perform services on our behalf, including without limitation, email delivery, abuse prevention, and legal services. For example, we currently use Cloudflare services (including Cloudflare Turnstile) to protect the Services against abuse and Mailjet to deliver notification emails.
Legal Compliance and Protection of BrickStep and Others: We may disclose your information if required to do so by law or on a good faith belief that such disclosure is permitted by this Privacy Policy or reasonably necessary or appropriate for any of the following reasons: (a) to comply with legal process; (b) to enforce or apply our Terms and this Privacy Policy, or other contracts with you, including investigation of potential violations thereof; (c) to respond to your requests for customer service; and/or (d) to protect the rights, property, or personal safety of BrickStep, our agents and affiliates, our users, and the public. This includes exchanging information with other companies and organizations for fraud protection, and spam/malware prevention, and similar purposes.
Business Transfers: As we continue to develop our business, we may engage in certain business transactions, such as the transfer or sale of our assets. In such transactions, (including in contemplation of such transactions, e.g., due diligence) your information may be disclosed. If any of BrickStep' assets are sold or transferred to a third party, customer information (including your email address) would likely be one of the transferred business assets.
Consent: We may disclose your information to any third parties based on your consent to do so.
Aggregate/De-identified Information: We may disclose de-identified and/or aggregated statistical information about the operation and use of the Services to third parties for any purpose.
5. Legal Basis for Processing Personal Data
The laws in some jurisdictions require companies to tell you about the legal ground they rely on to use or disclose information that can be directly linked to or used to identify you. To the extent those laws apply, our legal grounds for processing such information are as follows:
To Provide the Services: Much of our processing of information is to provide services to our users, including processing uploaded files, generating and providing the requested output files, as well as sending the requested email notifications.
Legitimate Interests: In many cases, we handle information on the ground that it furthers our legitimate interests in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals, these include:
- Customer service
- Protecting our users, personnel, and property
- Operating, maintaining, and securing our Services
- Analyzing and improving our Services
- Managing legal issues
We may also process information for the same legitimate interests of our users.
Legal Compliance: We may need to use and disclose information in certain ways to comply with our legal obligations.
Consent: Where required by law, and in some other cases where legally permissible, we handle information on the basis of consent. Where we handle your information on the basis of consent, you have the right to withdraw your consent; in accordance with applicable law.
6. Online Analytics
We may use third party web analytics services (such as analytics provided by Cloudflare) on our Services to collect and analyze the information discussed above, and to engage in auditing, research, or reporting. The information (including your IP address) collected by various analytics technologies described in Section 2 will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Services, including by noting the third party website from which you arrive to our Websites, analyzing usage trends, assisting with fraud prevention, and providing certain features to you.
7. Your Choices and Data Subject Rights
You have various rights with respect to the collection and use of your information through the Services. Those choices are as follows:
Optional Email Notifications: You are not required to provide an email address to use the Services. If you choose not to provide one, you will still be able to use the Services, but you will not receive email notifications when processing is complete.
EU Data Subject Rights: Individuals in the European Economic Area ("EEA") and other jurisdictions have certain legal rights (subject to applicable exceptions and limitations) to obtain confirmation of whether we hold certain information about them, to access such information, and to obtain its correction or deletion in appropriate circumstances. You may have the right to object to our handling of your information, restrict our processing of your information, and to withdraw any consent you have provided. You also have the right to go directly to the relevant supervisory or legal authority, but we encourage you to contact us so that we may resolve your concerns directly as best and as promptly as we can.
8. International Transfers
Our computer systems are currently based in Poland. As described in Section 4, we may share your information with trusted service providers in countries other than your country of residence, including the United States, in accordance with applicable law. This means that some of your information may be processed in the United States, which may not offer the same level of protection as the privacy laws of your jurisdiction. By providing us with your information, you acknowledge any such transfer, storage or use.
If we provide any information about you to any third parties information processors located outside of the EEA, we will take appropriate measures to ensure such companies protect your information adequately in accordance with this Privacy Policy and other data protection laws to govern the transfers of such data.
9. Security Measures
We have implemented technical, physical, and organizational security measures to protect against the loss, misuse, and/or alteration of your information. These safeguards vary based on the sensitivity of the information that we collect and store. However, we cannot and do not guarantee that these measures will prevent every unauthorized attempt to access, use, or disclose your information since despite our efforts, no Internet and/or other electronic transmissions can be completely secure.
10. Children
The Services are intended for users over the age of 18 and are not directed at children under the age of 13. If we become aware that we have collected personal information (as defined by the Children's Online Privacy Protection Act) from children under the age of 13, or personal data (as defined by the EU GDPR) from children under the age of 16, we will take reasonable steps to delete it as soon as practicable.
11. Data Retention
We retain the information we collect for as long as necessary to fulfill the purposes set forth in this Privacy Policy or as long as we are legally required or permitted to do so. Information may persist in copies made for backup and business continuity purposes for additional time.
12. Third Party Links and Services
The Services may contain links to third party websites or services. BrickStep is not responsible for the content or privacy practices of such third party websites or services. The collection, use and disclosure of your information will be subject to the privacy policies of the third party websites or services, and not this Privacy Policy. We encourage you to read the privacy statements of each and every site you visit.
13. Changes to this Privacy Policy
We will continue to evaluate this Privacy Policy as we update and expand our Services, and we may make changes to the Privacy Policy accordingly. We will post any changes here and revise the date last updated above. We encourage you to check this page periodically for updates to stay informed on how we collect, use and share your information. Any changes to this Privacy Policy will become effective on the date indicated above.
